By accessing or using the PropSight Property Inspection Platform ("Platform") at propsight360.app, including receiving SMS messages from PropSight, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree to these terms, please do not use the Platform or reply STOP to any SMS message to opt out of text messaging.

2. Program Description

PropSight is a property inspection platform that facilitates remote property inspections for mortgage lenders, loan servicers, appraisers, and inspection companies. The Platform enables homeowners and borrowers to complete property inspections by submitting photos, property condition information, and floor plan measurements through a secure web interface accessed via unique magic links.

As part of this service, PropSight sends transactional SMS messages and emails to homeowners/borrowers to deliver inspection links, reminders, floor plan scan instructions, and status updates.

You are opted in to receive SMS messages from PropSight when your mortgage lender, loan servicer, or property inspection company submits a property inspection order and provides your phone number as part of the order. By providing your phone number to your lender or inspection company for the purpose of property inspections, you consent to receiving transactional SMS messages from PropSight related to your inspection.

Consent to receive SMS messages is not a condition of purchasing any goods or services. You may opt out at any time.

7. Mobile Phone Number Privacy

Your mobile phone number will not be shared with, sold to, rented to, or disclosed to any third parties for marketing or promotional purposes. Your number is used exclusively for delivering transactional messages related to your property inspection. For full details, see our Privacy Policy.

8. Use of the Platform

When using the PropSight Platform, you agree to:

• Provide accurate and truthful information about the property condition.
• Submit photos that accurately represent the current state of the property.
• Not misrepresent the condition of the property or submit fraudulent information.
• Not attempt to access inspections or data belonging to other users.
• Not interfere with or disrupt the Platform's functionality.
• Use the Platform only for its intended purpose of completing property inspections.

9. Inspection Data

All information, photos, and floor plan data submitted through the Platform become part of the inspection report and will be shared with the ordering party (your lender, loan servicer, or inspection company). By submitting inspection data, you acknowledge that this information will be used for property valuation, loan servicing, insurance, and related purposes as determined by the ordering party.

10. Intellectual Property

The PropSight Platform, including its design, features, and content (excluding user-submitted data), is the property of Vallateral and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our express written consent.

11. Disclaimer of Warranties

The Platform and SMS messaging services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure. We do not guarantee delivery of SMS messages, as delivery depends on your wireless carrier and network conditions.

12. Limitation of Liability

To the fullest extent permitted by law, PropSight and Vallateral shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or SMS services, including but not limited to damages for loss of data, revenue, or business opportunities. Our total liability shall not exceed the amount paid by you (if any) for use of the Platform.

13. Modifications

We reserve the right to modify these Terms & Conditions at any time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of the State of California.
